Terms of Service
These terms govern your use of The Fractional Files website and the digital products sold here. By using the site or buying a playbook, you agree to these terms.
1. The seller
The Fractional Files is operated by [Controller name — e.g. The Fractional Files OÜ] (the "seller"), registered in [EU country of establishment].
2. What you're buying
The playbooks are digital products — documents, spreadsheets, prompts, and videos delivered electronically. There is no physical shipment.
3. Price, currency, VAT
Prices are shown in EUR and include EU VAT where applicable. The exact VAT rate is determined at checkout based on your billing country. Lemon Squeezy acts as the merchant of record and handles VAT compliance.
4. Delivery
After successful payment you receive an email with download links and access to the materials. Delivery is typically immediate.
5. Refunds — 14-day money-back guarantee
If a playbook isn't useful to you, email us within 14 days of purchase at [hello@thefractionalfiles.com] and we will refund you in full. This is in addition to your statutory rights under EU consumer law (Directive 2011/83/EU).
Important — withdrawal right for digital content (Art. 16(m), Directive 2011/83/EU): Because the playbooks are digital content delivered immediately, you waive your statutory 14-day right of withdrawal at the moment we make the files available. Our voluntary 14-day money-back guarantee replaces it on more generous terms.
6. Licence
When you buy a playbook you get a non-exclusive, non-transferable, perpetual licence to use the materials for:
- your own work, and
- the client work you personally deliver.
You may not:
- resell or redistribute the raw files,
- repackage them as a competing product,
- publish them in a way that lets others download them.
If you breach the licence we can revoke your access and seek damages.
7. Lifetime updates
When we update a playbook you have already bought, you get the updated files free. We may discontinue updates with reasonable notice.
8. Acceptable use of the site
Don't try to break, scrape, or abuse the site. We log abuse attempts and may suspend access.
9. Liability
To the maximum extent allowed by law, our liability for any claim is capped at the price you paid for the relevant playbook. Nothing in these terms limits liability that cannot be limited under EU consumer law (e.g. death, personal injury, or fraud).
10. Governing law and disputes
These terms are governed by the law of [EU country of establishment]. Disputes go to the competent court of [EU country of establishment], without prejudice to your mandatory rights as a consumer. EU consumers can also use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr.
11. Changes
We may update these terms. Material changes are announced on the site and (if you have an account) by email at least 30 days in advance.
